Hello, I’m Ched Jennings, Founder of the Jennings Law Offices in Louisville. If you’ve been injured on the job in Kentucky, there are 3 ways to resolve your workers’ comp claim. However, there are important considerations to keep in mind.
The first way is to settle directly with the insurance company, without an attorney. The insurance company will have an attorney to prepare your settlement documents. There may be terms you don’t fully understand or you may agree to give up something you may need down the road. Remember, that attorney represents the insurance company; not you. So, this may not be your best option.
The second way is to settle your claim through mediation, with the help of your attorney. I’ve included a link to a video about mediation at the bottom of this page. Many injured workers actually prefer mediation because it normally results in a lump sum settlement and it’s a quicker way to resolve your claim.
When needed, the third way is when a workers’ compensation judge decides your case and determines the weekly benefits you’re entitled to receive.
We’ll discuss which route might be best for your specific situation, during our initial interview. While there are 3 ways to resolve your workers’ comp claim, if you have serious injuries, you don’t want to make this decision on your own. Workers’ compensation benefits enable you to get the medical treatment you need and to be paid for the time you’re off work to recover. Make sure you get what you deserve.
